Butner Public Safety reminds residents that All-Terrain Vehicles (ATVs) are subject to specific North Carolina laws designed to protect riders, pedestrians, and motorists. Please review the information below before operating an ATV.
What is an ATV?
Under North Carolina General Statute 20-4.01(1c), an ATV is defined as a motorized vehicle that:
- Is 50 inches or less in width
- Is designed to travel on three or more low-pressure tires
- Is intended primarily for off-highway use
- Is designed to be straddled by the operator with handlebars for steering
Not Considered ATVs
The following vehicles are not classified as ATVs under this statute:
- Golf carts
- Utility Task Vehicles (UTVs / side-by-sides)
- Riding lawnmowers
These vehicles are regulated under separate North Carolina laws.
ATV Operation Laws in North Carolina
No Use on Public Roads
ATVs may NOT be operated on:
- Streets
- Roads
- Highways
Exception: ATVs may only cross a roadway when done safely and directly.
ATVs cannot be registered with the DMV for roadway use.
Required Safety Equipment
All ATV operators and passengers must wear:
- DOT-approved helmet
- Protective eye goggles
Failure to wear required safety equipment may result in enforcement action.
Age and Passenger Requirements
Age Restrictions
- Children 8 years old and younger may not operate an ATV
- Riders under 16 years old must be under adult supervision at all times
Passenger Rules
- Passengers are only allowed if the ATV is designed by the manufacturer to carry more than one person
Safety Reminder
Improper ATV use can lead to serious injury, fatalities, citations, or vehicle impoundment. Residents are strongly encouraged to:
- Operate ATVs only in designated off-road areas
- Always wear proper safety gear
- Complete an approved ATV safety course when available
